9 months in hit and run

Ray Homann III was sentenced to nine months in the Clay County Detention Center after he entered a plea in the 2018 hit-and-run fatality of Randall Shorty Penland. During Superior Court in Swain County on Jan. 19, Hohmann was sentenced to a total of 270 days.

Hohmann, 40, pleaded no contest to two misdemeanors – obstruction of justice and death by vehicle – in lieu of the felonies the state had initially brought against him. Clay County Sheriff Mark Buchanan said Penland’s family was apprised of all aspects of this case and independently made the decision to accept the plea.

Penland, 49, was found in the roadway on U.S. 64 East near an apartment complex in the early morning hours of Nov. 16. An investigation by the N.C. Highway Patrol and sheriff’s office led to the determination that Penland’s death was a result of a hit and run.

Hohmann is also a defendant in a civil suit involving Penland’s death.
